1. Acceptance of Terms

By accessing and using the Prime VR Tour website at https://primevrtour.com or by engaging our services, you confirm that you have read, understood and agree to be bound by these Terms & Conditions and our Privacy Policy.

If you do not agree to these terms, please do not use our website or services. We reserve the right to update or change these terms at any time without prior notice. Your continued use of the website following any changes constitutes acceptance of those changes.

2. Website Use

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the website. You must not:

• Use the website in any way that violates applicable laws or regulations
• Attempt to gain unauthorised access to any part of our systems or services
• Transmit harmful, offensive or disruptive content
• Use automated tools to scrape, copy or redistribute our content without permission
• Impersonate any person or misrepresent your affiliation with any entity

3. Services

Prime VR Tour provides professional photography, videography and virtual tour services including 360° virtual tours, Matterport 3D scans, Google Street View trusted photography, drone photography and videography, and related digital media services.

The scope, deliverables and timeline of each project are agreed upon before work commences. Any changes to the agreed scope may result in revised pricing and timelines.

4. Quotations

All quotations provided by Prime VR Tour are estimates based on the information provided at the time of enquiry. Final pricing will be confirmed once we have assessed the property and project requirements. Quotations are valid for 30 days from the date of issue unless otherwise stated.

Prime VR Tour reserves the right to revise pricing if the scope of work changes materially from what was originally described.

5. Payments

Payment terms will be specified in your project agreement or invoice. We typically require an advance payment before scheduling a shoot, with the balance due upon delivery of final files. All prices are inclusive of applicable taxes unless stated otherwise.

We accept bank transfer and other payment methods as agreed. Failure to make timely payment may result in delays to your project or suspension of access to delivered content.

6. Project Timelines

Estimated delivery timelines are provided as a guide and are subject to factors including weather conditions, property access, post-production complexity and third-party platform processing times (such as Google Street View or Matterport). We will make every reasonable effort to meet agreed timelines and will communicate promptly if delays arise.

7. Client Responsibilities

Clients are responsible for:

• Ensuring the property is accessible, clean and ready for photography at the agreed time
• Obtaining any necessary permissions for photography on the property
• Providing accurate property details and contact information
• Being available or having a representative present during the shoot
• Reviewing and approving deliverables within the agreed timeframe

Prime VR Tour is not liable for delays or additional costs arising from the client's failure to fulfil these responsibilities.

8. Intellectual Property

All photographs, videos, virtual tour files and other content created by Prime VR Tour remain the intellectual property of Prime VR Tour until full payment is received. Upon receipt of full payment, the client is granted a licence to use the delivered content for the agreed purposes as specified in the project agreement.

Unless expressly agreed in writing, Prime VR Tour retains the right to use the delivered content for promotional and portfolio purposes. All content on our website, including text, graphics, logos and images, is the exclusive property of Prime VR Tour and may not be reproduced without prior written consent.

9. Portfolio Usage

By engaging our services, you grant Prime VR Tour the non-exclusive right to use photographs, virtual tours and related media produced for you in our portfolio, marketing materials, website and social media channels. If you require work to be kept confidential, please inform us in writing before the shoot date.

10. Cancellation & Termination

Either party may cancel or terminate a project by providing written notice. Cancellation charges may apply depending on the stage of the project. Please refer to our Refund & Cancellation Policy for full details.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Prime VR Tour shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with the use of our website or services, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or related to our services shall not exceed the total amount paid by you to Prime VR Tour for the specific project giving rise to the claim.

12. Force Majeure

Prime VR Tour shall not be held liable for any delay or failure to perform its obligations if such delay or failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, floods, fires, pandemics, government actions, power failures or internet outages. In such circumstances, we will notify you as soon as reasonably practicable and work together to reschedule.

13. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
